Objective

 

Objective This document presents Instituto Repartir's Privacy Policy in relation to the collection and management of personal data, in accordance with Federal Law No. 13,709/2018 (General Personal Data Protection Law – LGPD).

 

In addition to clarifying how Instituto Repartir handles the personal data to which it has access, this Privacy Policy aims to record the free, clearly informed and unequivocal statement by which the Concordia Holder handles the processing of their personal data for the specific specifications of Instituto Repartir, described in article 3 of its bylaws, namely:

 

The Association (Instituto Repartir, a non-profit organization) has the specific objective of providing access, training, opportunities to generate income and transform social reality to young people in situations of socioeconomic vulnerability through work in the area of ​​social communication.

 

As one of the forms of financing the social project, Instituto Repartir provides communication services to other organizations on a paid basis, whilst still observing its principle of being a non-profit entity.

 

It is understood as the Holder of the beneficiaries and supporters of Instituto Repartir, including its collaborators, partners and relationship networks.

To benefit from social support and the provision of communication services, the ease of this policy is necessary.

 

About data collection

Instituto Repartir collects personal data from young Communication students who register for the project selection process. This data is collected through a completed form (Google Forms) and sent by the candidate to Instituto Repartir. The sole purpose of this collection is to select young people to be impacted by the social journey.

 

As the socioeconomic criterion is essential for determining the young people chosen in the process, the average monthly income per person in your household is asked on the form. In any case, the questionnaire opens up the possibility of the person not answering this question. Likewise, Instituto Repartir wants to serve young people within the criteria of representativeness of Brazilian society in terms of gender, color or race and sexual orientation. Therefore, these sensitive data are asked in the same questionnaire, but with the possibility of the respondent feeling free not to answer or not to classify themselves in any of the proposed options.

 

The data collected in the registration form are as follows:

 

  • Full name

  • Date of birth

  • City and neighborhood of residence

  • E-mail

  • College where you study Communication course

  • Course semester

  • Course period

  • Average monthly income per person in your household

  • Self-declared color or race gender identity sexual orientation

  • Possession of physical, mental or intellectual difficulties or disabilities

  • Computer access in your home

  • Internet access in your home

People interested in receiving periodic updates on the work of Instituto Repartir through a newsletter can also voluntarily register on the Repartir website or in the newsletter itself. The decision to register is voluntary and consented to by the user. The user can cancel the registration at any time, upon request made by the user to Instituto Repartir.

The data collected during registration to receive updates are as follows:

  • Full name

  • Email

In both types of collection (registration for the social event and registration to receive news by email), Instituto Repartir receives personal data directly from the Data Subject for the proposed purposes. Occasionally, the request for some information may be made through direct contact between Instituto Repartir and users via email, telephone, WhatsApp or through text messaging tools available on social networks.

In this way, Instituto Repartir is authorized to have access to this personal data voluntarily provided by the Data Subject.

Cookies


The Instituto Repartir website, hosted on the Wix platform, uses cookies when browsing its users. According to the platform's clarifications, essential cookies are used for different reasons, such as:

  • To provide a great experience to its visitors and customers.

  • To identify its registered members.

  • To monitor and analyze the performance, operation and effectiveness of the platform.

  • To ensure that the platform is secure.


Wix recommends that visitors to the Instituto Repartir website be directed to good sources of information about cookies, such as All About Cookies, so that they are able to see which cookies are used and how to manage them properly.

Relationship with the public and their Data Subjects


The use of the data provided by the Data Subject will be for the specific purpose of the Instituto Repartir.

The communication materials developed by the Instituto Repartir for internal and/or external dissemination that involve data from impacted young people, impacted organizations or partners must be approved in advance by the partners before being disseminated. In the case of organizations, they are responsible for checking the information provided by their Data Subjects and for authorizing the use and sharing of their Data Subjects' personal data.

Organizations impacted by services provided by the Instituto Repartir are responsible for managing and authorizing the use of sound and image of their publics. In the case of sharing this information with the Instituto Repartir so that it can carry out its work, such organizations are responsible for managing and protecting the personal data of these Data Subjects.

If these organizations do not agree to make such information available (whether they are their own or that of their partners), the Repartir Institute will be exempt from liability if data and information with more detailed investigation are missing.

Purposes of data processing

The processing of the data listed in this term has the following purposes:

  • To enable Instituto Repartir to select young people to be impacted by its social training and inclusion journey.

  • To enable Instituto Repartir to produce informative content related to its work and the impacts it has achieved, as a way of providing society with transparency about this work.

Data security

The information and data provided by the Data Subject will be stored internally at Instituto Repartir on a physical drive (external HD, computer with antivirus security) or in cloud tools with password access.

Whenever personal data is collected directly by cloud providers, or third-party services to which Instituto Repartir may be a subscriber or have access with the free authorization of the Data Subject, Instituto Repartir is exempt from any responsibility for the security, storage and/or privacy of any information collected.

Use of personal data

Instituto Repartir undertakes not to transfer or disclose the personal data provided by the Data Subject, except in the cases indicated below:

  • With suppliers, partners, service providers, audit agencies, etc., whenever the processing of the information is necessary to provide a high-quality service.

  • With government agencies, always at the official request, as a matter of applicable regulation and approved by law.

  • With a court, to defend our legal rights or to limit damages in litigation.

  • For any necessary cases mentioned or other adverse situations, the Data Subject will be informed for legal consent on their part.

 

 

Retention and deletion of personal data

 

Instituto Repartir may retain the Data Subject's information for as long as necessary for the purposes described in this Privacy Policy and to comply with applicable regulatory requirements, provided that we have legitimate business purposes and are permitted by law.

Once the personal data storage periods have expired, they are removed from Instituto Repartir's databases, except in cases where there is a possibility or need for storage due to a legal or regulatory provision.

 

Anonymized personal data, without the possibility of association with the individual, may be kept for an indefinite period.

 

The Data Subject may request via email or correspondence to Instituto Repartir, at any time, that the Data Subject's non-anonymized personal data be deleted. The Data Subject is aware that it may be unfeasible for Instituto Repartir to continue offering its services to the Data Subject after the deletion of the personal data.

Legal bases

Contracts

In the case of the legal basis of contracts, personal data may be processed by Instituto Repartir in two cases: the first is to fulfill an obligation provided for in a contract, and the second when the data processing serves to validate and initiate the validity of an agreement.

 

Other legal bases

In addition to those mentioned above, there are other types of legal bases that may justify the processing of personal data:

  • Legal obligation: in this case, the processing of personal data is justified by requirements of other laws. These are the scenarios in which Instituto Repartir needs to use or store personal data to fulfill legal obligations.

  • Execution of Public Policies: when the processing of personal data is protected by the public interest or by the need of an official authority exercising the role of controller of that data.

  • Studies by research bodies: personal data may be processed for the purposes of studies by officially accredited bodies, such as research. In this case, whenever possible, the data must be anonymized by Instituto Repartir, ensuring the privacy of the Data Subjects as much as possible.

  • Legal Proceedings: personal data may still be processed to exercise rights in legal actions.

  • Protection of Life: it is possible to justify the processing of personal data when its use is in the vital interest of the Data Subject or another person.

  • Health Protection: when health professionals, health services or health authorities need to process personal data.

Rights of the Data Subject

As defined in the LGPD, the Data Subject has the following rights:

  • Confirmation of the existence of processing: to know whether or not their data is being processed by Instituto Repartir.

  • Access to data: if processing is confirmed, the Data Subject has the right to access it in a controlled manner, in order to prevent access to their data by others.

  • Correction of incomplete, inaccurate or outdated data: subject to the limitations required by law for maintaining a history, their data may be corrected.

  • Anonymization: transformation that prevents the identification of the Data Subject, when this is not necessary.

  • Processing limitation: this is the Data Subject's right to limit the processing of their personal data, which can be obtained when they contest the accuracy of the data, when the processing is unlawful, when Instituto Repartir no longer needs the data for the proposed purposes and when they have objected to the processing of the data.

  • Elimination of unnecessary, excessive data or data processed in non-compliance with the LGPD: this is the right to have the data deleted, except under the conditions provided for in the same Law.

  • Elimination of data or right to be forgotten: this represents the right to have their data deleted from Instituto Repartir's systems, except under the conditions provided for in the same Law.

  • Information about sharing: to be informed about the sharing of their data and with which entities.

  • Refusal of consent: when consent is requested for the collection and processing of data, they will be informed of the consequences of non-consent.

  • Revocation of consent: revocation may be requested at any time by the Data Subject's express statement. Revocation does not cancel previous treatments, unless the deletion is also formalized.

 

Changes to the Privacy Policy

This Privacy Policy may be updated and changed at any time as a way of confirming the privacy and protection of personal data. If any purpose for collecting data is different from that presented here, we will request new authorizations and update this Policy.
